THE 2024 FROGTAPE PAINTOVER CHALLENGE SWEEPSTAKES – OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
VOID WHERE PROHIBITED BY LAW.
Sweepstakes Period: The 2024 FrogTape Paintover Challenge Sweepstakes (the “Sweepstakes”) begins at 12:00 p.m. Eastern Time (“ET”) on August 7, 2024 and ends at 11:59 a.m. ET on August 21, 2024 (the “Sweepstakes Period”).
Eligibility: Open to legal residents of the 50 United States and D.C., who are 18 years of age or older as of date of entry. Void where prohibited or restricted by law. Employees of Shurtape Technologies, LLC (the “Sponsor”), its respective affiliates, parents, subsidiaries, divisions, suppliers, distributors, and advertising, promotional and judging agencies and Influencers involved in the Sweepstakes (collectively the “Sponsor and its Administrators”) and each of their respective employees, shareholders, directors, officers, members, assigns and agents and their immediate family members and/or those living in the same household of each are not eligible to participate or win.
How to Enter/Vote: During the Sweepstakes Period, visit https://www.frogtape.com/paintoverchallenge and follow the online voting instructions to vote for your favorite FrogTape Paintover Challenge Room Makeover (“Vote”) and then complete the required registration form to receive one (1) entry into the sweepstakes (“Entry”). Influencers may vote for his/her own Room Makeover but may not win a prize in this Sweepstakes. Limit one (1) Vote/Entry per person/email address, per day during the Sweepstakes Period. Any attempt by the entrant/Influencer to vote/enter more than the number of times authorized herein, using multiple names or e-mail addresses and/or any other fraudulent mechanism(s), including robotic, automatic, programmed or similar methods, shall give the Sponsor, in its sole discretion the right to nullify all such votes and to disqualify the responsible individual from voting/entering. Such actions may, in the Sponsor’s sole discretion, result in the disqualification of the Influencer Room Makeover which was voted for. Any attempt by any entrant/Influencer to obtain more than the stated number of votes/Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such Entries and that entrant will be disqualified and disqualification of the Influencer Room Makeover. Normal Internet/phone access and data/usage charges imposed by your online/phone service provider will apply.
Random Drawing: The winner will be selected in a random drawing to be held on or about August 23, 2024 from among all eligible Entries received. The odds of winning will depend on the number of eligible Entries received throughout the Sweepstakes Period. The random drawing will be conducted by an independent judging organization whose decisions are final on all matters relating to the Sweepstakes.
Grand Prize: One (1) Grand Prize will be awarded: $1,000 cash, awarded as a check. All federal, state, and local income taxes for acceptance and use of the Grand Prize are the sole responsibility of the winner. No substitution or transfer of prize permitted.
Winner Notification/Verification: The potential Grand Prize winner (“Winner”) will be notified via U.S. Mail and/or email at the street address or e-mail address provided during Entry submission and will be required to sign and return, a Declaration of Eligibility & Liability Release and where legal, a Publicity Release (where legal) (collectively “Declaration”) within five (5) days of notification attempt. Noncompliance within this time period may result in disqualification and an alternate Winner may be selected and notified, as indicated above. Prize notification returned as non-deliverable or if potential Winner is not eligible, it will result in disqualification and the prize will be forfeited and an alternate Winner may be selected and notified, as indicated above.
General Rules: A 1099 tax statement will be filed with the IRS for the value of the prize and the 1099 form will be sent to the Winner via U.S. Mail, to be processed by the Winner in the year in which he or she receives the prize. By participating in this Sweepstakes, entrants/Winner agrees to be bound by these Official Rules and the decisions of the Sponsor. All applicable laws and regulations apply. Entrants and Winner hereby hold the Sponsor and its Administrators and each of their respective officers, directors, members, managers, employees, agents, representatives, successors and assigns (the “Released Parties”) harmless from and against any third-party claim arising from use of any Entry and Entrants/Winner waive any right to inspect or approve uses of their Entry by Sponsor in connection with the Sweepstakes or to be compensated for any such uses. Participating in the Sweepstakes constitutes permission to the Sponsor to use an Entrant’s/Winner’s name, address, and likeness in connection with the administration of the Sweepstakes only and as otherwise required by law. By participating in the Sweepstakes, the Entrant/Winner agrees that Released Parties will have no liability whatsoever for, and will be held harmless by Entrant/Winner for any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from Entry, the acceptance, possession, use or misuse of prize, if applicable, or participation in the Sweepstakes or participation in any Sweepstakes related activity. You hereby represent and warrant that you have read these Official Rules and are fully familiar with their contents and agree to be bound by them. The Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials or the offering or announcement of the prize. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures threaten the integrity of the Sweepstakes; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Sweepstakes as determined by Sponsor, in their sole discretion. In the event of termination, the drawing for the prize will be conducted from among all eligible Entries/votes received prior to termination. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry/voting process or the operation of the Sweepstakes; violates the Official Rules; acts in an unsportsmanlike or disruptive manner; or acts in an annoying, abusive, threatening, or harassing manner.
Disputes: ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE APPROPRIATE STATE OR FEDERAL COURT LOCATED IN OHIO IN THE U.S.; (2) ENTRANT HEREBY WAIVES HIS/HER RIGHT TO SWEEPSTAKES JURISDICTION; (3) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT ATTORNEYS’ FEES; AND (4) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the state of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Ohio.
Privacy: Any personally identifiable information collected during your participation in this Sweepstakes will be used by Sponsor and its agents for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules, and in accordance with Sponsor's Privacy Policy, posted at http://frogtape.com/privacy and as allowed by law.
Winner List: To obtain a copy of the Winner List, available for sixty (60) days after September 1, 2024, send an email to: [email protected] with “FrogTape Paintover Challenge 2024 Sweepstakes Winner (01-2465-22)” as the subject line. Winner List will be sent after the prize has been awarded.
